Kyle Sandilands news: New details shared about Kyle Sandilands’ fight against ARN as it heads to court with claims shock jock will use ‘the dump button defence’


Kyle Sandilands is taking his fight against ARN to court after his axing, and it’s starting tomorrow, it’s been revealed.

Speaking on Sydney’s 2GB on his show on Thursday, Ben Fordham revealed proceedings are taking place on March 27 at 9am and that a document filed was an affidavit from Sandilands, 54, citing the shock jock’s full name, Kyle Dalton Sandilands.

An affidavit is a written statement used as evidence in court.

Fordham claimed on a previous show this week that Sandilands will “use the dump button defence”.

“131873, the open line number, one of the biggest court cases of 2026. Looks like it’s going to start tomorrow. Our entertainment editor Peter Ford has sent me a copy of a screenshot from the Commonwealth Courts,” Fordham said.

“And it says here, 27 March, 9am, first case management hearing before Justice Stewart.

“And some more information, documents filed, Notice of Acting, Appointment of Lawyer, Australian Radio Network, that’s ARN, Affidavit from Kyle Dalton Sandilands, originating application, Kyle Dalton Sandilands, Concise Statement, Kyle Dalton Sandilands.

“So, it’s kicking off tomorrow by the looks of things in the Federal Court of Australia.”

Fordham also claimed Sandilands will “use the dump button defence”.

“2GB Breakfast can reveal Kyle Sandilands is going to use the dump button defence.”

”On the radio show he hosted with Jackie O, there was a 30-second delay. And because of several breaches of the radio codes, the censor was employed by the radio station.

”They worked for the radio network and independently of The Kyle & Jackie O Show, and if the conversation headed into dangerous territory, the censor would beep out anything deemed to be too risky.

“On the morning of Kyle and Jackie O’s now infamous on air-argument, the censor didn’t beep any of it.”

“It’s my understanding that it’s written into Kyle’s contract that the radio station is responsible for what goes to air.

“The radio station is actually obliged to dump anything that breaches the signed agreement between ARN and Kyle.

“So, if anything being broadcast placed Kyle in breach of his contract, the radio network had a duty to dump it.

Fordham shared audio from an old segment in 2025 where Kyle and Jackie O appeared to have a tiff and Henderson claimed she was getting “f–king gaslit”.

It was claimed to not have gone to air at the time, but was broadcast later.

“In fact, the fight was packaged up and used for a future segment. They didn’t want to waste it,” Fordham said.

“And this is going to be part of the argument from Kyle Sandilands. If he didn’t face any disciplinary action over the incident in 2025, how’s it fair to sack him for something similar in 2026?”

Sandilands previously released a statement, announcing his termination from ARN. 

“ARN has just announced that they’ve terminated my contract. I don’t accept it. My lawyers told them last week this would be invalid. And guess what? It is,” he claimed.

“Let me tell you what actually happened here. Jackie and I had a blue on air. That’s it. The kind of thing we’ve done a hundred times in 25 years. And ARN took the situation and decided to try and burn the place down.

“They sacked Jackie. They suspended me. They wouldn’t even let me pick up the phone to call her or anyone else on the show.

“Then – and this is the bit that gets me – once they’d made it impossible for the show to go on, they turn around and say, ‘You didn’t fix it. You’re fired!’

“They didn’t want to fix this. They thought they saw a chance to get out of the contract they signed with me a year ago, and they ran with it.”

He added in part that he’s leaving things in the hands of his lawyers.

“I’ve got a contract until 2034. I’ve got rights under that contract. And ARN hasn’t honoured the contract. So, it’s over to my lawyers,” he said.

ARN issued a statement to the ASX. 

“ARN Media Limited advises that it has issued a notice of termination of contract to Mr Kyle Sandilands and Quasar Media Services Pty Ltd (Quasar Media),” the statement read.

“As a result, the Kyle and Jackie O show will no longer be presented.

“This decision follows the Company’s ASX announcement on 3 March 2026 which outlined that ARN had provided written notice to Mr Sandilands and Quasar Media stating that it considered Mr Sandilands’ behaviour during the broadcast of 20 February 2026 to constitute serious misconduct and a breach of ARN’s services agreement with Quasar Media, under which Mr Sandilands presents the Kyle and Jackie O show.

“As noted in the 3 March 2026 announcement, Mr Sandilands was given 14 days to remedy the breach.”

Sandilands was stood down following an on-air clash with Henderson on February 20, after she read from Andrew Mountbatten-Windsor’s astrology birth chart.

Henderson, 51, broke her silence in a statement days later claiming she “did not quit or resign” from The Kyle and Jackie O Show after the program was pulled from the KIIS FM airwaves by ARN.

“It has been truly heartbreaking to see how this has unfolded. At this stage, I am unable to say anything further, as I am addressing this through the appropriate legal channels,” she said in part.
